Just remember, the reason the Police are reacting in such a heavy-handed manner is because the 1% are very scared of us.

Psalm 123: 4 Have mercy upon us, O LORD, have mercy, * for we have had more than enough of contempt,

5 Too much of the scorn of the indolent rich, * and of the derision of the proud.

[-] 1 points by professorzed (308) from Hamilton, ON 13 years ago

The Police certainly need a lot of armour and weapons, shields and a sonic cannon to deal with peaceful, unarmed protestors practicing their first Amendment rights.

[-] 0 points by raines (699) 13 years ago

You consider muder and rape to be peaceful?

[-] -2 points by Gbus (80) 13 years ago

Actually, you guys make up about 2% of the population, and you're losing support very fast, police are evicting the camps because the avg american has grown weary of OWS, I used to be an anarchist that lived on the street, and you had my support till yesterday, peaceful protesters, declaring class war, not listening to others and being ignorant and closed minded towards others and each other, duh

LOL - "The 1% are very scared of us."

The city is clearing the park for health reasons. In the letter distributed, it said it was temporary. You are going to be allowed to return.

What the hell is all the bitchin' about? The city is being overly accomodative, in my opinion. OWS is just looking for a reason to get all riled up and act out their frustrations. Grow up.

[-] 2 points by arglooblaha (1) 13 years ago

Hell of a way to temporarily clear a park...

[+] -4 points by goingdown (9) 13 years ago

If they grew up, they'd have to find jobs and be responsible citizens. Its never going to happen.

[-] 4 points by Jaid0gz (7) 13 years ago

Are you ignorant enough to see that the lack of jobs created to enhance competition and corporate profits is one of the things protesters are working for? Telling us to grow up means that you obviously haven't because you have no experience and are most definately not a responsible citizen if you haven't woken up to the facts.

[-] 0 points by NotYour99 (226) 13 years ago

What you call fact, others call bs.

[-] -1 points by FreeMarkets (272) 13 years ago

Camping out in a park is not "working". Start a company and create some jobs as an entrepreneur. THAT is working.

[-] 2 points by zaphod (4) 13 years ago

So you want them to (a) either find a job or (b) get funding to start a business - both during an ongoing recession primarily brought about by the corrupt practices emanating from Wall Street and Washington. Get real.

At least these guys have the guts to go out and stand up for what they believe.

[-] 2 points by SwissMiss (2435) from Ann Arbor Charter Township, MI 13 years ago

Ditto! All most opponents to this movement know how to do is run their biased mouths.

[-] -1 points by FreeMarkets (272) 13 years ago

Yes. You got it exactly right. Except the "get funding" part: Most business startups are bootstrap financed.

[-] 1 points by zaphod (4) 13 years ago

Sometimes they may be bootstrap-financed, but speaking from direct personal experience, that's also very hard in recessionary times. And boostrapping only gets you to the first stage, before you need to find more funding. FYI I've worked and paid my taxes for 20+ years in the high tech industry, and after being laid off with hundreds of others, found myself having to make my way as an entrepreneur. The same then also happened to my PhD-qualified wife. Her brother's construction business also had to close down. It's plain to see something's badly screwed up in the way our current system is being run - and the rot all starts in Wall Street and Washington.

[-] 1 points by MattLHolck (16833) from San Diego, CA 13 years ago

it is near impossible to find a job

[-] 13 points by HitGirl (2263) 13 years ago

Stay non-violent. Let them waste their energy and their precious dollars.

[-] 8 points by Silica (51) from Suisun City, CA 13 years ago

Agreed. Remain non-violent even in the face of ejection. Hopefully nobody will be injured (police included) and the people in Zuccotti Park can stay united in one place or another.

[-] 3 points by TheTideIsTurning (8) from San Francisco, CA 13 years ago

Yes ... be creative, be strong, but please remain peaceful. I know that (some of) the police are being violent, and it must be tragic to watch what you've built be carelessly tossed away and friends and allies be hurt.
Please stay peaceful and this can end up bringing more support to the movement. Strategically, non violence / creative peaceful actions will bring more support, more allies, more traction for the bigger changes we're trying to make. You have ignited a new era which will continue and grow ... as one great article said, "the toothpaste will never be put back in the tube".

I wish we were closer to the day when the majority of cops realize that they are the 99% also, connect with their humanity and go after the real criminals, not those standing up for justice. I believe that day can come, after more work is done including support networks for those who risk their jobs defying orders.

Thank you for your dedication.

It's difficult for me to tell what's happening since the stream is incredibly laggy and unfocused. Hoping for the best does not preclude suspicion to the contrary. I have seen the results of previous police action in other Occupies but that does not stop me from hoping for the best, especially in light of the fact that there is nothing I can do right now to affect the outcome tonight.

[-] -1 points by raines (699) 13 years ago

[-] -2 points by Thrasymaque (-2138) 13 years ago

[-] 1 points by jart (1186) from New York, NY 13 years ago
[-] 0 points by Thrasymaque (-2138) 13 years ago

I understand that. But does this call to action imply the use of violence by the protesters. What's your position on violence and Occupy. Just curious.

[-] 3 points by jart (1186) from New York, NY 13 years ago

There, before the Stock Exchange, we will exchange stories rather than stocks.

Does that sound violent to you?

[-] -2 points by Thrasymaque (-2138) 13 years ago

A few words on a poster don't mean much. We've seen this throughout history many times. The whole setup Occupy is using at the moment leads me to believe it is preparing to enter a second stage where violence will be called upon and become a staple of the movement. The poster for this call to action is a big giveaway, so is the way Occupy is framing itself at the moment.

[-] 4 points by jart (1186) from New York, NY 13 years ago

We've never advocated violence on this website. I just heard a moment ago that a city council member is bleeding from the head after being beaten and arrested by the police. An entire refugee camp is being destroyed and evicted. The police just threw hundreds of donated books in a dumpster. Personal possessions are being destroyed. They are sawing down trees. If you're so opposed to violence, why aren't you shaming the NYPD for their present violence? Why are you more concerned with discrediting the movement based on a hunch that occupiers might become violent?

This is because in our current system, people are conditioned to believe that violence against those above on the social hierarchy is unthinkable, but violence against those below is justice. It's disgusting.

[-] 2 points by liberation (13) from Roseville, CA 13 years ago

You know why it is a big deal for our movement to be associated in any way with violence? Because that is the slightest excuse that the 1% and authorities anywhere look for and need to play on the terms that they are most effective in, which is force and violence. Violent acts that many of these radicals are hinting or suggesting do nothing for the movement or common good. This is the quickest way to undermine our movement and more likely than not, the very same 1% would love to plug in their own radicals to place blame on the whole movement and encourage this sort of fatalistic thinking...

[-] 1 points by jph (2652) 13 years ago

obviously they don't need an excuse like "protester violence" they just make up some lies about what ever they like,. every action has a reaction.

Help comes in various ways. Sometimes one doesn't recognize it at first, sometimes one never does. You seem to think criticism is a burden, I see it as as crucial element in critical thought. If I were anywhere near an Occupy camp, I would be right there on the front lines questioning the movement at every step. I find this is the best type of help I can provide.

My position is based on more than a hunch. It is based on years of reading various thinkers and seeing what is happening with Occupy. The movement is being setup to incite violence at this point. If you want me to explain in detail I will. However, I don't want to waste my time writing if you are not open to criticism.

There was brief period where I believed in Occupy, but after tearing apart the layers and inspecting the seed of the fruit, my thinking has changed. Perhaps I shouldn't have read so much Derrida, perhaps I should be willing to trust Occupy 100%, but I can't do this anymore. I can only bring critical thought and analysis in an unbiased form. The cover of a book doesn't tell the story. You have to deconstruct it to see what is really there. And, this has nothing to do with siding with the government and being against Occupy. I don't take a stand right now. I just analyze what is going on to further my comprehension. I don't favor any party, Occupy, nor the US government. I doubt all with the same Descartian approach.

[-] 1 points by ThePoopSmitty (6) 13 years ago

Are you saying that at this time in the movement your position is that of an objective observer?

[-] 0 points by Thrasymaque (-2138) 13 years ago

Not exactly. I'm saying that my position is one that tries to be objective. Objectivity is a complicated thing, there is always some subjectivity involved. My position can be just as objective/subjective as jart's or anybody elses. We have a different experience with different view points. She's on the scene, I have a different vantage point. I am far away in Bali.

What I'm saying is that criticism is not evil. The best thinkers had the best critics. Arguments do not get strong magically. They get strong when they are challenged and survive the assault. Some thinkers like René Descartes understood this to the point that they published their critics themselves.

Read how this thread started. HitGirl and Silica both promoted non-violence and peace. Jart came in and questioned their stance by criticizing it and labeling it naive. I, in turn, criticized jart for doing this because it seemed to me she was making a call for violence. She responded and explained her side. This is called a discussion. It helps us get an inch closer to the truth.

As for my current beliefs on Occupy. Here they are: http://occupywallst.org/forum/deconstructing-occupy-a-message-within-a-message/ I am open to your criticism as it will help me forge stronger arguments. Please take a moment to read and respond. All view points are welcome. Let us work together as the 99%.

[-] 1 points by naravenhawk (2) 13 years ago

Thanks for this message in this thread...

I've been studying Arendt's "Origin's in Totalitarianism" this semester via a graduate seminar. This class has been a great counterbalance to understanding where the movement is today, and where it could be later. I would hate for this movement to become the "Tea Party part 2" as the pendulum swings the other way... or worse as a party ruled by 'the mob'(which would imply that the assembly morphed into something different later).

To keep the 99% from becoming a 'mob' we MUST have criticism amongst ourselves as you had so stated:

"Help comes in various ways. Sometimes one doesn't recognize it at first, sometimes one never does. You seem to think criticism is a burden, I see it as as crucial element in critical thought."

This criticism is the invisible factor that is necessary to keep us on track in a positive manner. Questioning are we a violent movement, or will we move to violence is important. When we identify ourselves by answering, "that we are a PEACEFUL PROTEST", that shapes who we are... This helps keep us from entering into the mistakes that have occurred through history.

[-] 1 points by ThePoopSmitty (6) 13 years ago

Being truly objective is not easy. It requires effort and flexibility. To be honest I'm not even sure true objectivity is even obtainable but I think you can get close. You have to exercise it in the same vain you would exercise your body. Thanks for your reply,I'm going to read your thoughts a little later today and I'll get back to you. I'd very much like to continue this conversation. As far as my thoughts on criticism. Criticism is a great tool to further and refine exchange of ideas as long as it is constructive and not laced with a hurtful nature. It too requires exercise and much like Comedy, timing is everything. . Thank you

[-] 0 points by Thrasymaque (-2138) 13 years ago

If I criticize Occupy it is not to bring it down, but to make it stronger. I hope it can succeed, but I do not believe it will in its current form. I think there is a wide gap between Occupy's theory and practice. I would love to discuss this further, and will always read the replies of anyone who puts forth arguments of worth. Hell, I read almost everything on this forum including the God awful crap posted by anti-semite trolls.

[-] 1 points by ThePoopSmitty (6) 13 years ago

I think what you are doing is important. You can't deny that Occupy is using very powerful iconic images to invoke an emotional response. Branding as they say in the biz and I think you are correct to question the intent. I appreciate you offering this perspective on this and thank you for doing so. My personal thoughts are they are using this tactic to plant the seed but I feel the fruit of this action will look vastly different from that seed. If this movement is truly about what it says it is about and is committed to being non-violent I think you'll see the branding/protests take on more of a comical and frivolous nature. Once again thank you for the fresh perspective.

I hope you all know that you are only hurting small business and encouraging big business to move to other countries that are more than willing to accept them with open arms while you still buy their products every day and night. Get off your ass and find a way to support the local business and the people who are trying to make a living still in this economy. Also by requiring a login in and setup to your specific rules that state you can tell people what to do when to do it and how to do it is worse than many communist countries have it today. (it makes your complete movement hypocrite's and the opposite of freedom of speech.)

[-] 1 points by zaphod (4) 13 years ago

The current disastrous economic is what's what's destroying small business and hurting major corporations too. Those very economic conditions were caused by what has been going in in Wall Street and in Washington, and which Occupy Wall Street is protesting against.

[-] 0 points by whisper (212) 13 years ago

What got us into the abyss is our government's interference in our economy. Force and coercion cannot maintain a balanced economy. Only the freedom to deal with those you wish to deal with and avoid the others can.

[-] 2 points by JesseHeffran (3903) 13 years ago

One of greatest economic minds, in my opinion, was Adam Smith. In the “Wealth of Nations, he said, “As soon as the land of any country has all become private property, the landlords, like all other men, love to reap where they never sowed, and demand a rent even for its natural produce.” This idea leads to the concept of the government being a referee. One of our problems is that our referee, in comparison to corporate power, is a lap dog. The trickle down economics that has been one of the biggest blights this nation has encountered is because too many people want to neuter the perceived enemy, the gov’t. So I guess what I’m saying is that the reason the government is growing is because corporate power is growing. Who contributes more to the bloated government than the one percent? They have pretty much created a system that privatizes profits and socializes losses. This dynamic gives them more power to buy more votes, which expands the government even more. In a democratic republic, if the government becomes a thorn in your side, you have to ask yourself who in the private sector benefits. Then you find the real tyranny. so in rebutting your statement, The bigger government gets the more corrupt it is, period!, I’d say the more consolidated corporate power becomes the bigger government gets.

This is disgusting to me..I would never have thought that the police would actually destroy the library and set books to fire (though that has happened notoriously in the past to keep information from reaching our minds) , destroy the kitchen and personal belongings. Wtf are we in some third world country? Whatever happened to our permit being the Article V?! This is enough for me to leave this forsaken country.

This was a beautiful country in the makings, originally. Hell, we even had hemp growing in the beginning. George washington was a proud hemp grower and Old Glory was made of hemp fibers. We are reversing in our progress. And no, not just because of hemp, obviously. Because we are passing and making laws for profit..

Disgusting. I am sick of this country.

[-] 0 points by whisper (212) 13 years ago

The last sentence of the second paragraph is the largest single cause of the problem. If our state and economy were separated in the same way the church and state are separated, most of the evil this country's leaders participate in would be impossible.

The commerce clause must be abolished from the constitution.

1:38 a.m. Unconfirmed reports of snipers on rooftops.

This type of reporting is not news and should be removed. Occupy should not be inducing fear if its aim is to remain non-violent, certainly not when the report is not backed up by any proof. It seems this line is just here to demonize the cops and expand on the sense that Occupy protesters are victims.

Keep up the fight #ows. This struggle needs to continue. The injustices in the United States need to be addressed and the establishment isn't very willing to distance itself from the status quo. [-] 1 points by Hardworkingteacher (10) from Bronx, NY 13 years ago

My point was that we can't get a full picture from local media. The NYPD was not allowing CBS to video what was taking place from the air. 30 minutes of watching broadcast news had not yielded this information. The Guardian was blogging live from the scene and, as I've found on a number of occasions, had more detailed and comprehensive coverage of what was happening. Thought others might benefit from another news source.

New York City Nov. 15, 1011, 3:15AM

just got back from downtown -- not all the way to zuccotti. police blocked off access to the park. nobody could get within two blocks of it. they humiliated themselves.  pathetic.  pushing us back and back.  i ask what is this about and was told by a number of cops -- apparently this was their talking point -- that we're blocking pedestrians. i pointed out that this is my neighborhood and i know that the only pedestrians to be found here at two AM are us.  everything is closed. no workers, no shoppers.  why insult me with bullshit? why not just say you were told to prevent us from witnissing what's you're doing a couple blocks south at the park?  i'd understand. but i won't be told to go home for no good reason.  i was talking to them the entire time non-stop; very slowly and calmly.  interesting.  they would listen.  a few broke rank enough to respond politely at moments of calm and then got violent and stupid only to relax a few minutes later.  you can see i'm speaking to you with respect. i know you go home to some of the worst-hit neighborhoods -- foreclosures, etc. you're union guys.  we consider you to be allies.  we have union people down here all the time. we’re fighting for your neighborhoods. please think later tonight about what you were doing.  i'm in front with a very large cop's hand  pushing on my neck then sticking his bat in my gut.  all about nothing.  no property being even spat on, no violence.  a pretty dumb spectacle.  a hard place for them to be -- they're on the job following orders from above. no way to know to what degree they're conscious of why they're doing what they're doing aside from the on-the-job-following-orders rationale. i mentioned that i recall watching the news when the police demonstrated for better pay.  i said to the TV -- "carry on, guys. you deserve to get paid a decent wage."  so i know you know there's nothing wrong with occupying public property to protest.  i told them we understand you're working a job, probably supporting families.  but please -- later on think about it on the way home.  people are being banged up, arrested.  i say, in a tone that resembles a concerned friend -- if you're kids ask you why you were doing this to people with absolutely no pretext, what do you say to them? you're faces are being broadcast all over the web right now and will be all day tomorrow.  you'll see yourself manufacturing an ugly riot about nothing.  there will be a documentary about this event in a few years and you'll be right there -- there you are. you and your kids will see. that's the side of history you stood on.  you'll say to yourself "that was me creating a riot on orders from above. there i am banging on the only pedestrians in sight. that’s me."

Because beyond all else, America has gone mercenary. It's about the money and maintaiing the money. Even if it means taking the freedom from your neighbors, seizing his or her home, or more.

Thank you for your dialogue with the cops. I hope it has a positive affect at some point.

I was down there a couple weeks ago, visited for 4 days, left some moose jerky with your kitchen on three occasions.

I wish I could be there tonight.

Please stay safe. Please stay non-violent.

Take care of each other.

[-] 0 points by agnosticnixie (17) from Laval, QC 13 years ago

By and large, this; police unions are more guilds than unions.

[-] 1 points by alouis (1511) from New York, NY 13 years ago

The very job description of a cop mens he can't be "union." He is a scab herder and strike breaker. And their lawless behavior qualifies them as a gang.

You're in fantasy land if you think you're going to woo over the cops with this bullshit. The only reason he appeared to listen was that he didn't want to bash your head in and have to fill out all the paperwork.

You're going to need imagery today. Get flags and hold them high. Get people singing the national anthem - as many as you can.

The press may have been locked out, but you have phones and cameras. What you want is your country waking up this morning to a flood of videos of a huge group of people peacefully singing their nation's anthem under its flag while the police work to dismantle it.

That's your image. Get to it.

It was well-documented before the protest began that 1% of Americans hold roughly 24% of the country's wealth. OWS shined a bright light on that fact, and it will never be the same now, whether the police put their big boots down on people or not. Change is coming. Write it down. Make it happen.

Don't let go of your peaceful resistance, your morality in the face of their brutality will be your evidence of their corruption when the time comes to tell your stories. Be brave, even braver than you've already been. Things are changing because of you.

2:44 a.m. NYPD destroys OWS Library. 5,000 donated books in dumpster.

Really? And this is a Republic we "live" in? This Republic. What choice do people have? The message is: You are not wanted. You are not welcome in New York. You are not welcome in the human race. The taunts are clear: dirty, hippies, criminals, and lazy. Which is nothing but racist code used by those who are too afraid to face reality and say what they REALLY mean. They are weak minded. They are afraid. They say that they might agree with your message, but not your tactics. What tactics then do they agree with? Complaining and then doing nothing? No! The time for that has come and gone. There are no leaders in power of this government, there are only opportunists. No man for legislative genius has ever appeared here. The state will only appeal to your bodily senses and never to your mind. They are not armed with honesty, but only physical strength. They can only, like spiteful boys, punish you like a dog. Is it the state that says to you: your mere existence is making the world a worse place in which to live? Is it not a person's duty to act as though that idea is unacceptable? So then Washington and Franklin, who were branded rebels, should have accepted their place in history and serve the King? They can only twist words and actions to suit their own needs and self-righteously demand we keep quiet in divisive servitude. How they don't realize that they don't serve the King, but they serve the King's wherewithal so they may live as such "dignified" rulers of the meek without having an ounce of dignity in their bones.

Simple and honest. I have been studying Police and Military tactics since I was 7 and mastering Panzer Blitz and dreaming of being a detective. Though I decided to become a paramedic instead, I still watch and study these thing to this day. This is blatant and very obvious, what they are doing. "They" want the protesters to get violent. They want you guys and gals to get ugly. Then you defeat yourself and allow them the reasons they need to step this up. Its called escalation. Look it up, its a very basic and widely used tactic. STAY PEACEFUL!! The 1% has been using terror, war, police brutality, crusades, ethnic cleansing, etc, etc, etc for TENS OF THOUSANDS OF YEARS!!! They do not even understand the concept of peace. It is outside their very perception of reality. The only way you are going to win this #OWS, is if you stay peaceful! I cannot stress this more.

They came like thieves in the night...Bloomberg's Blue Shirts...and robbed us of our rights, and our possessions. All the while preventing reporters from reporting on the scene. Bloomberg, the self-proclaimed number one defender of free speech (pause for gagging), said in no uncertain terms: "yes, you have the right...the right to remain silent. So just shut up and obey". This is only the beginning dear Mayor .0001%. This WILL be your legacy- of repression. But you will NOT succeed. These mayors, governors, city councils, police chiefs, and street cops of America need to realize that it is NOT UP TO THEM whether or not Americans peaceably gather, protest, discuss, or demonstrate. It's up to a document called the US CONSTITUTION. You can beat us and arrest us and tear-gas us, you can try to "permit" us to death....but you can't kill an idea. You can't keep down a people’s hopes and dreams for a better life....for us, and for our kids. America USED to work. The people had work. The system worke (sort of). Hey, EVEN the Congress used to work (sometimes). God knows, it was far, far, far from perfect -but at least we all had some share in the struggles AND the rewards. But somewhere along the way, we lost our way. Because now we have an economy and a political system that seems to work only for the rich. With OWS America has found it’s voice, and that voice demands fairness and justice - for ALL. This land IS our land! AND WE WANT IT BACK! We want our LIVES back! We want our FUTURE back! But it’s much more than just words.... it’s much more than politics..... it’s your freakin’ LIFE, and how you want to live it, and how you WILL live it. Find a quiet place somewhere, and consider this: Each of us has only one brief life....one chance....one roll of the dice....and many choices. The time has come to choose....to risk...and to act. If not now...then when? If not you, then....who? You DO have the power my friend....and the choice IS yours. Don’t let your dreams die...

Destroying 5,000 books is what part of hygiene?

As abhorrent as this action is, we should remember that this is how the police treat the homeless all over the country, year in and year out. They always destroy their possessions, since the homeless have so much money to spare. It is always sold in terms of "health and safety", even as these people are chased around from one miserable spot to another. OWS has just made this visible - reminded the U.S. of just how crooked and rotten so-called "laissez faire", as actually implemented, really is.

[-] 2 points by Aker (1) 13 years ago

The world IS watching but I don't think many Americans are. I'm curious to see what people's reactions will be tomorrow morning, when all the dust settles. As an American watching from Beirut, all I can see on ABC news is sex scandals and the stupidity of Herman Cain. The funny thing is the Arab revolution was broadcasted 24 hours a day. The Arab governments were criticized for using violent police tactics, the people were whole-heartedly supported. What about our revolution? If what I'm seeing now in New York and Oakland occurred in the Arab world, their would be an outrage. I'm disgusted by the hypocrisy, at the cowards in state government, at the fear tactics used by the 1%... Is this American democracy? If we have any dignity as a nation the occupy movement must be allowed to exist and flourish. Stay put, we are with you!

It's absurd. In Siria have to win the protester and the leader of this Country has to give up the Power. In the States have to win the corporations which have destroyed the economy and the protesters have to give up their idea of freedom and democracy. When the Power use the violence, it means that has no more arms to defend its privileges. "Sursum corda". The time of the victory has never been so near.

[-] 2 points by albiss007 (1) from Fairfield, CT 13 years ago

Yes, there are concerns for health. But to go in to the park, unannounced, after midnight with the NYPD in riot gear? You've got to be kidding me. There is a better, more rational way to deal with health concerns. Also, camping out is a form of protest. It's a sit in; refusing to move until your goal is accomplished. It's a tactic that has been used time and again. Not to mention these protesters are non-violent in principle and nature. Bringing riot gear in the dead of night to a peace rally is unacceptable. Stay strong out there; I wish I could be with you

[-] 0 points by imthe4percent (56) 13 years ago

Unacceptable is occupying land that does not belong to you and not giving a damn about the people who live and work in the neighborhood. I have called the Mayor and NYPD to offer my thanks and appreciation. OWS has the right to protest, the 1st Amendment does not give the right to do anything you want when you want. Get used to it or go home.

[-] 0 points by jayp74 (195) 13 years ago

Agreed. Actually, I think the city is being overly accomodative. In the letter which was distributed to the "occupiers", they said it was temporary and being done for health reasons. Of course, none of these folks believes that. They just want a reason to spread out accross the city and raise hell.

I like the name --- I think I'm one of the 4% also.

There is no such crime as “resisting arrest.” This is a fictitious crime dreamed up by law enforcement to accuse a citizen of a crime when they refuse to surrender to the illegal demands of the police. The U.S. Supreme Court has ruled on numerous occasions that resisting a false arrest is not merely a citizen’s right, but his duty! In fact, the Supreme Court has gone so far as to rule that if a law enforcement officer is killed as a result of actions stemming from a citizen’s attempts to defend themselves against a false arrest, it is the fault of the officer, not the citizen. Here’s a short collection of relevant court rulings on false arrest and resisting arrest: “When a person, being without fault, is in a place where he has a right to be, is violently assaulted, he may, without retreating, repel by force, and if, in the reasonable exercise of his right of self defense, his assailant is killed, he is justified.” Runyan v. State, 57 Ind. 80; Miller v. State, 74 Ind. 1. “These principles apply as well to an officer attempting to make an arrest, who abuses his authority and transcends the bounds thereof by the use of unnecessary force and violence, as they do to a private individual who unlawfully uses such force and violence.” Jones v. State, 26 Tex. App. I; Beaverts v. State, 4 Tex. App. 1 75; Skidmore v. State, 43 Tex. 93, 903. “An illegal arrest is an assault and battery. The person so attempted to be restrained of his liberty has the same right to use force in defending himself as he would in repelling any other assault and battery.” (State v. Robinson, 145 ME. 77, 72 ATL. 260). “Each person has the right to resist an unlawful arrest. In such a case, the person attempting the arrest stands in the position of a wrongdoer and may be resisted by the use of force, as in self- defense.” (State v. Mobley, 240 N.C. 476, 83 S.E. 2d 100). Do individuals have the right to come to the aid of another citizens being falsely arrested? You bet they do. As another court case ruled: “One may come to the aid of another being unlawfully arrested, just as he may where one is being assaulted, molested, raped or kidnapped. Thus it is not an offense to liberate one from the unlawful custody of an officer, even though he may have submitted to such custody, without resistance.” (Adams v. State, 121 Ga. 16, 48 S.E. 910). And on the issue of actually killing an arresting officer in self defense: “Citizens may resist unlawful arrest to the point of taking an arresting officer’s life if necessary.” Plummer v. State, 136 Ind. 306. This premise was upheld by the Supreme Court of the United States in the case: John Bad Elk v. U.S., 177 U.S. 529.

Well the news says this http://www.nbcnewyork.com/news/local/Occupy-Wall-Street-Protests-Sweep-Cops-Riot-Gear-133859263.html

Police handed out letters to protesters ordering them to temporarily evacuate the park, and campers were ordered to remove all their tents. Police claimed it was a health issue, and that the park needed to be inspected.

Protesters were told they will be allowed to return to the park in several hours, but without their property, which will be brought to a sanitation garage.

[-] 0 points by Silica (51) from Suisun City, CA 13 years ago

That's consistent with what the girl on the feed said about the police distributing papers, though there's still some room for doubt as to their true intentions. For example:

Why are they asking protesters to abandon their property? It could very well be taken with them.

What guarantee does anyone have that they will be allowed to resume occupation of the park? What kind of timeline are they looking at for cleaning the park?

What sort of health issues are they concerned with? There are certain risks inherent to large gatherings (spread of cold or flu, for instance) but the ambiguity of the statement is cause for concern. It would help tremendously to know what the current state of the park is. Is it on the level of Portland or just moderately messy for a gathering of that size?

Lastly, how do they expect anybody to continue the occupation after they've had their property taken? This is what makes me most suspicious of their intent.

[-] 0 points by din365 (36) 13 years ago

That's the thing. It's a smokescreen to needlessly seize their stuff so they will loose the will to protest and disperse, and they hope without their stuff, the winter element will spell then end of the OWS movement. I think the late George carlin said it best when he said "the elite will do what they want anyways", which is clearly evedent here.

[-] 1 points by angelofmercy (225) 13 years ago

What ever , I watched OWS stream last night . The police were handing out papers. While OWS screamed at them , rather then picking up their stuff and leaving. OWS was told a month ago to get of the park so it could be cleaned. A month is long enough to gather your things and move out.

The OWS General Assembly and the DNC have repeatly met in secret to keep the movement from Occupying the White House from fear of offending the current President. Shame!! The President has stated publicly he supports the movement, but behind the scenes is trying to block the movement with continued distraction. The fact is the President has given specific instructions to the Capitol Police that if the White House is Occupied, that they are to stand down, and not steal Tents and Generators. Yet OWS in it's corrupt secret meetings are trying to continue to persuade the ranks they are doing the right thing for now...WRONG.. The time is growing shorter to be able to maintain momentum of he 99% without a cohesive party and candidates to put into Congress. Nothing will get accomplished without that happening. And I do completely understand the desire for no leadership, leader, goals, etc, because that is limiting. But that is the past. We can do it differently, but we will loose people without a focus that includes gaining power in the political system. The goals can include ideas for small contributions from many to back candidates. I understand $ + power = corruption. There are different ways. Vouchers going to people through tax return for $50 that does into the election fund. Others contribute as they can, maximum $200. That would iclude the corporations who are enow "people". We need the various Occupiers to send their best and brightest for a conclave to work out initial . We pretty much all know our concerns and that this government is weak, corrupt and run by big $. We know the inequalities. A united, well thought out consensus and action has to be in place before our concerns can be addressed and changed. Time for thoughtful, united, powerful action that has some teeth. Look to past social and political revolutions for possible ideas.

Can anyone from OWS PLEASE confirm or deny one man died from a heart attack when being dragged by police? I don't want to list his name here for obvious reasons but the initials are B.P. I sincerely hope the info is wrong but please let us know. Thank you!

TPTB are very scared of 'The People' and it sure shows when they resort to this low tactic. They are trying to elicit violence with this kind of action and continual use of provocateurs, but WE are in control of our actions and every America should be proud of OWS. If they hoped to stop OWS, they can watch OWS grow!

They can take our stuff, they can bring the bulldozers, teargas, riot gear and provocateurs but they will NEVER take the will and power of the People United... this is solidifying the movement and it is proving the point, the government doesn't work for 'The People' and the NYPD police action this early morning is showing those who haven't noticed, the growing Police State of America is quite serious and
*AMERICA IS A CLOSING SOCIETY!

As for the stuff they trashed, it is just stuff and I just hope everyone is safe; more stuff is on the way. Solidarity Stay strong, stay peaceful, stay safe!

[-] 0 points by vets74 (344) from New York, NY 13 years ago

I hate to write this up. It is unpleasant all around.

There is a nasty contrast there between Zuccotti Park and a CEO office up on the 17th Floor at 115 Broadway -- corner of Cedar Street, straight up from the red Joie de Vivre statue. It speaks to where our society has turned itself.

Zuccotti Park is a protest against crime. A protest against smash-the-economy and grab everything crime. World record crime.

They stole $7-trillion nationwide.

$2-trillion with fraudulent appraisals and hidden balloon condition mortgages. $5-trillion of pension fraud executed in Manhattan with bribery-driven "AAA" ratings and the infamous credit default swap schemes (such as the $2-billion Goldman, Sachs "Abacus" fraud.)

They are thieves.

Manhattan prosecuted no one. Not one of the thieves.

No laws enforced. This, despite the many hundreds of documentations and open admissions to the legal elements of Common Law fraud. Local jurisdiction for these crimes; but no rule of law whatsoever for the Wall Street 1%.

They are thieves, so there is a protest.

Now, Zuccotti gets cleared. Lawful force is applied, if not exactly a.s.a.p.

The Mayor is on teevee arguing that Occupy presents a hazard to the public. Law is applied to compel "compliance with our laws."

Still, we in the area know that the lawlessness of Manhattan for the Wall Street 1% has been allowed to extend to the most serious crimes. This went to massive theft and even included a death, a horrible DUI killing.

The victim of that crime was Florence Cioffi. She was hit by an SUV on Water Street, back on January 25, 2008. The driver kept going. When he came back and surrendered, he was tested dead drunk. That is what you get when big time Wall Streeters go to Rangers hockey games.

This driver was a CEO. No question about it, the law was not applied to him.

He did not do the minimum New York State sentence for DUI hit-and-run and serve three years. He didn't even do one year.

CEO sentence for a DUI killing in Manhattan is 16 days in Rikers and a $350 fine.

The discussion at the sentencing hearing in 2009 was whether he could do the 16 days on weekends.

Wouldn't want to interfere with a CEO's "job creator" functions, don'tcha know.

And yes, of course, a contributor to the Republican Party.

We'll have to ask whether this man has a stylish pair of black wings to wear when he looks down from his office window on Zuccotti Park and recalls the filthy protesters being dragged off.

FOLLOW THE MONEY always leads to somebody's interests.

Does it hurt when private property is taken by force? Perhaps right to property is as inalienable as right to free speech.

[-] 1 points by vnayar (289) from Brooklyn, NY 13 years ago

I guess that's why they put "rights to property" in the Constitution. Oh wait they didn't. Maybe the Declaration of Independence? Nope not there either.

I'm not sure where you're from, but in this country the ideals are life, liberty, and justice. A right to life means nothing without a right to the means of life. A person has no "right" to own to the point where people cannot sustain their lives. The role of the government is not to protect the aristocracy.

I am a NY taxi driver. At around 1:30AM I was going down Broadway. At Canal Street I saw at least a couple of dozen cop cars parked and full of cops. Further down traffic became impossible and stopped at Courtlandt Street. As I live and breathe ICE (Immigration) cops were in the street. I came back about an hour later. People were marching up Broadway and I honked a friendly honk and some cheered. The occupiers are heroes and I know that this way or that, this movement is far from finished.

[-] 1 points by inlikeflint (42) 13 years ago

Why not? Where do the homeless sleep? Why can't you sleep in a park?

[-] -1 points by Thrasymaque (-2138) 13 years ago

I'm not an expert, but there are city rules. You can't compare a few homeless people sleeping in a park with a full encampment. The homeless are not allowed to sleep in parks, but the government tolerates it because it's not a real problem. A camp in the middle of a city is. There are real health concerns and these involve the other people in the city. Protesting is fine, but when it starts to invade the rights of other citizens there must to be a limit. Nothing stops you from doing marches and protesting in various areas during the day. There is no reason to form a camp where the authorities cannot clean the public space, and where other citizens cannot use it. It's public, it's not your private property. Camping and protesting are two different things. Are you a protester or a camper?

[-] 3 points by BreadLandPeace (359) 13 years ago

It's not ok to be a camper, and it's ok for banks to throw people out of their homes? This courageous stand by NY OWS starkly reveals in miniature what the .01% are doing to the country--stealing their belongings, evicting them from their homes. And doesn't that book burning, er, book dumping have some scary implications? Stay strong, stay peaceful, we love you! Unlike Oakland, everyone here can see who causes the violence. This is an historic moment.

[-] -1 points by Thrasymaque (-2138) 13 years ago

It's not ok to be a camper, and it's ok for banks to throw people out of their homes?

That's a logical fallacy and you know it. Two wrongs don't make a right.

What the banks did is horrible, and you should be protesting against that. But camping is a whole different matter. Occupy could stay strong and protest daily without endangering the lives of others through the spread of disease that comes with long term camping. They would probably be able to do a better job since they wouldn't have to waste so much effort in running the camps in the first place.

[-] 2 points by BreadLandPeace (359) 13 years ago

You might be right about the camping situation, but if it didn't attract such dangerous people and some freeloaders, it might work. But it's ridiculous for the mayors and police to claim they're concerned with health and safety--how healthy and safe are the thousands upon thousands who have been turned out into the streets in recent years? (And that recent move in NY to steal the heaters from the park because they might catch on fire--then why is the mayor closing firehouses all over the city, and why do they allow slumlords to let housing violations go unchecked while poor people live in fire traps?)

I'm not sure it was a fallacy to say that protestors aren't allowed a place to protest if that includes living in a camp, meaning they use it as a home; and people who have homes get evicted because they can't afford the payments. I think the connection I was trying to make is that the rulers are fine with denying people a place to exist, and they'll pretend to tolerate protest as long as it doesn't take any more material form than words (powerful as they are). I agree, it wasn't a great sentence.

Watching the eviction of the Liberty OWS camp tonight, I saw it as a miniature version of what's going on in the country: people are being evicted from their homes and their belongings, like their life savings, are being destroyed, just what we saw in microcosm tonight in Zuccotti Park.

The beautiful, incredibly restrained response to the eviction was a stunning victory, which I believe will mark a turning point in the movement. Not only was the disciplined resistance beamed around the world, but it's now a role model to other occupies in the country who have been struggling with what looks like coordinated evictions by the 1%. In two months the protestors have absorbed the lessons of Oakland and why it serves the 1% to let them make OWS look dangerous. New York is leading the way with tonight's heroic repudiation of police brutality and capitalist repression. I'm sure OWS's moral authority will continue to grow and win over a wider audience.

Thank you to the brave protestors tonight at Liberty Plaza, you were incredible.

[-] 1 points by whisper (212) 13 years ago

Government repression and capitalism are not compatible. Capitalism is an economic system in which the state and the economy are separate in the same way the church and state are (supposed to be) separate. What we have in this country is NOT capitalism.

[-] 1 points by BreadLandPeace (359) 13 years ago

Well what do we have? This isn't a joke, I'd like to know your analysis, I don't believe in slogans. But we need to know whom we're fighting if we want to change society. Thanks!

[-] 1 points by whisper (212) 13 years ago

We have a mixed economy in which some of the principles of capitalism are implemented, but in which the government may interfere. This interference is made possible by the commerce clause. This interference NEVER improves the efficiency with which goods are produced and NEVER lowers the costs of production. It gives government (which is by definition the organized use of force and/or coercion) the power to determine what you may produce, buy, how much, and at what price. Over time the Supreme Court has continuously expanded the power granted to congress by the commerce clause and since 1995, in United States vs. Lopez, they have expanded it to cover every area of human life. They ruled that the commerce clause gives government the power to regulate 'channels of commerce', 'persons and things' which 'move' in those channels, and things which 'significantly affect' commerce. Can you think of anything that would be exempt from one of those categories (which, of course, have no objective definitions)?

It is the commerce clause which provides the incentive for corporations to buy legislators.

[-] 1 points by BreadLandPeace (359) 13 years ago

Wow, thanks so much. I did not know what the commerce clause was. I'm not sure if I agree with your characterization of the state and the economy, but I'm so grateful to have this information. As soon as I get some more time I'd like to research your citation and learn more. Many thanks.

okay usually I don't say anything on others comments and I support a lot of open minded things, but to call someone (even if they are one) a Nazi is horrible and insulting (they might not be prod that they were one) and messed up, also I know plenty of republicans who are not Nazi's and they are not even moderate republicans, to make that claim is very closed minded and proves that you are no better than your own words. Just so you know by the way I am not a person who supports Nazi's I just think you are a closed minded hypocrite.

[-] 1 points by debndan (1145) 13 years ago

Maybe I am a bit closed minded, because I refuse to believe what people say, until I see what they do. I used to be naive and trusted the republican party. Believed in the party of lincoln, teddy roosevelt, and eisenhower.

That was then, this is NOW. When a 'moderate' repub can send in the cops in the middle of the night, then the whole party is a sham. Republicans are corrupt, have been using insider info for profit, tried to strip workers of labor rights, and been in the pockets of big banks for years now.

Not saying the corrupt dems are much better. But the NAZI comparison FITS the GOP. They have been, and right now ARE trampling the rights of the individual.

[-] 1 points by debndan (1145) 13 years ago

The GOP of the past 12 years is NOT the same party I grew up with.

Here's a question: which party, the Nazi's or the GOP, would open secret prisons, justify torture, keep track of peoples reading lists, perform mass wire taps, question peoples loyalty, and round up protesters in the middle of the night??

If you answered nazi's, you'd only be half right, it's the GOP

I have been watching this movement shift and change for months, somewhat almost passively in relation to my interest. The destruction of Liberty Square has mobilized my heart. I am now in this 100% acting in accord with the 99. We are winning. They fear us like no other because we are unstoppable. They will employ harsher tactics in the coming months, be sure of it, but our numbers swell by the thousands globally with each new day and with every usurpation of our human rights and constitutional freedoms. The media are fixed, but we have solutions. The American Mind is fickle but winnable in the end. Stay non-violent. Stay creative. The whole world is watching. Nov. 17 will live in infamy.

Call Mayor Bloomberg and demand he stop the police form violating the first amendment rights of occupiers in New York City

In NYC dial 311

Outside of New York City, call 212-NEW-YORK.

To Fax a message, dial 212-788-8123.

To send an email: http://www.nyc.gov/html/mail/html/mayor.html

Here's a sample letter:

Dear Mayor Bloomberg

Please support the first amendment rights of the occupiers in New York City.

It is reprehensible what mayors are doing in America.

Scott Olsen has been asking a question; "Are these the freedoms I fought for in Iraq? Are these the freedoms my brothers died for in Iraq?

I ask you sir to answer that question for us since police in Oakland have taken Scott's ability to speak away for the moment with a gas grenade to his head. I understand that you want to keep the city open for business but I'm afraid the "peoples business" takes precedent as it very, very occasionally does. Sorry for the inconvenience but this is one of those big moments that the robber barons and their servants, the bribed public officials and lobbyists can't do anything at all to stop except either support the right to peaceably assemble and redress our grievances or find themselves on the wrong side of history. You can't stop this.

Make no mistake, we are making history here. It's really easy, stand WITH US Mayor Bloomberg and you can make history too. Stop the eviction of occupiers from New York City now.

Don't you think its time for something a little more drastic? I say we start shooting some pigs before they shoot us.

eviction defense? are you for real? do you own the park? I know what you are going to said this land is own by the people,. OK I will go to your front yard and occupy it then said this land is own by the people. get your fact straight who is the rightful property owner of that park.

[-] 2 points by Jumphrey (106) 13 years ago

actually, that is owned by you, since you own the mortgage and what not... That park is public property.

[-] 1 points by Bellaciao29 (99) 13 years ago

If the park is public property, it's property of the protester, too. Moreover, it isn't just a a problem of property. Citizens have the right to protest everywhere and for every cause. It looks like strange that the inhabitants of Siria have the right to protest, while the Americans have no more the same right.

[-] 1 points by Kallero (1) 13 years ago

Are you fucking serious? You realize Syrians are being shot in the streets, right? With real bullets. Its sad and shameful that the American police are being used to abridging the right to assemble in this way, but to say that Syrians have the right to protest and we don't is just asinine.

Actually, no... The park is not public property . The park is owned by Brookfield Properties.

[-] 1 points by Jumphrey (106) 13 years ago

Kozibi9's comment was an honest clarification, I'm concerned with the utility of the point system when something so basic, and unbiased as that is being "disliked"....

[-] 0 points by freeusa (14) 13 years ago

to Jumphrey I said your front yard, not mine and if I had a mortgage so bank own it until I paid it off, and the park do close at dusk check with park department of city of new york. get you facts straight. OK

[-] 1 points by SwissMiss (2435) from Ann Arbor Charter Township, MI 13 years ago

It's not a city-owned park, so it doesn't have to shut down according to the city. Actually, from what I've read, it has to be open 24 hours to the public.

[-] 0 points by theflyonthewall (3) 13 years ago

Wrong, the park is owned by Brookfield Office Properties who built it and then opened it for public enjoyment - and they have been tolerant of your occupation until now - OWS finally wore out their welcome.

[-] 1 points by SwissMiss (2435) from Ann Arbor Charter Township, MI 13 years ago

The agreement is that the park HAS TO BE OPEN to the public. Brookfield isn't doing it just to be nice.

The park was originally built by a US Steel company in exchange for the right to add more stories to their office building sometime in the 1960's. Have you ever asked yourself the question of how did a public space built with the sole purpose of existing as a public space for come to be under the ownership of a major corporation? I'd like to hear your thoughts and feelings on that. Thank you

you need a camping permit though

I reply to myself to point out one thing that the OWS and those who still drilling on the topic who is who, you all got no point.

  1. how many of you did vote when comes to election in the USA?
  2. Protest is the right of the people-true, so does voting. you have the done your protest, how long do you think before I call you all a terrorist since your protesting is only making people sick?
  3. the number of the people who occupy the park can not represent 10s and thousand of us who also wanted to use the park, so you have your right to protest so do I have my right to use it. Go on and let other people use it as what was intend to.
  4. don't tell me you are there to help us to make a better world for tomorrow, cause no one knows whats coming tomorrow. stick to the point keep on blaming the rich only makes you less rich.
