If you refuse an order by a law enforcement officer or law enforcement office, you are committing a criminal act. Most protesters are now aware just how true this is. TechJunkie thinks that DHS should be allowed to create regulations for the internet instead of the FCC who is typically the office in charge of regulating communication.
What say you?
Should DHS get to bypass our democracy and create internet regulation that amounts to law because non-compliance is a criminal act?
Is this something that should be handled by the FCC in accordance with laws passed by congress?

Thx. I just see it as a breach between the separation of powers and potential for abuse. Obviously some people are ok with it but I have yet to see an argument that leads me to their side.

I can't begin to describe how fucked up it is that the US has secret laws. You can only rationalize and forgive so much of the similarities to Hitler and Stalin. I know people over use those names but if the shoe fits...
they also redefine words in secret to get around other laws. Like the 4th amendment.
That's how the NSA gets around spying on everyone's electronic messages. A computer system does it. It's not the same as a person listening to it. Pass enough filters... probable cause. ... or something.
Don't forget the use of private companies by the pentagon to bypass laws that prevent the from working domestically.
and private companies don't have to abide by the FOIA either. That's why they love organizations like Black Water.

Good point. Maybe if they(congress) were forced to spend time doing their jobs, like passing laws for regulations instead of passing it off to agencies, they would have less time on their hands to think up ways to fuck the citizenry.
the congress does do their job. the epa goes around congress as does the president.
...and the topic broadens. This really is a big issue. You make a good point that these activities need to be ended. Maybe a law that says laws are not valid unless passed directly by congress.
If you think actions of the Admin or the Pres is illegal, sue them.
I think you are mistaken. They are perfectly within their power. And anything they can do to cut pollution by the electric generation plants is welcome.
