I would be more inclined to flip them the bird, that is also a freedom, court cases have been overturned by the ACLU regularly because people were wrongly arrested for giving a cop a 1 fingered salute
Perhaps lawyers could provide a protocol for "flipping the bird". It could be disseminated to the crowd, practiced en masse, thus easily overturned in court the same way those you mention were.
Why would I hide my face? Protesting is not a crime, nor anything to be ashamed of if you hold your ideals as something to be valued. Criminals hide behind scarves and masks. Not citizens.

What a dual edged sword it is. Where are the legions of OWS camera snipers? Lip reading video experts can analyze police preperations, live time. Ideas ?
