Article II, Section 2 of the Constitution says the President of the United States nominates justices to the Supreme Court, with the advice and consent of the Senate. I can't find a clause that says "...except when there's a year left in the term of a Democratic President.”

Note: I fully expect total obstruction from the lockstep-ed GOP — So This Appointment might still be waiting for president Bernie to push through. The president can NOT do it alone = remove GOP from office.

The representatives' not taking the transitions of power seriously led to the 9/11 attacks and the traumas afterwards suffered worldwide. The people's business needs to be taken care of, regardless of partisan rancor.
Mega-Wiener and geoduck administrations had a much smoother transition of power in 2009 than that in 2001 from kryptonite to mega-Wiener administration. 9/11's lesson should not be re-taught.
The GOOP no longer knows how to rule just as the Demonrats scurried home rather than continued working on the health insurance reform (geoduck could not herd the ducks shirking their sworn duties like water off of their backs; geoduck, snooze, geoduck, lose). Their number-one job is campaigning/election, not governing. I say that all of their home districts should create model congress so that they can all stay home and work on home campaigning/election politics.
No matter whether we follow the poisonous Platy-Pus or the quack, quackery of the duck, geo-, agua-, aero-head-, or spaced-out-, we'll likely be all wet.
''The (Sickening) Glorification of Antonin Scalia'' - by Tom Carter:
which .. ''Scalia’s mere presence on the court testified to the advanced decay of American democracy. That decay is linked, on the one hand, to the extreme growth of social inequality, accompanied by the rampant parasitism and criminality of the ruling class, and on the other hand .. to unending war, which has its domestic reflection in the build up of the repressive state apparatus that Scalia championed.''
and: ''The bitterness of the disputes over his replacement is a reflection of the importance of his role in American politics over 3 decades during which the political establishment shifted violently to the right.''
