Forum Post: Stand and Speak with me in Court Against DISCOVER BANK in January in Honolulu

Each Occupy protester needs to remember who he or she is... we are living, breathing human beings, abiding by the Constitution and we are not CORPORATIONS. It is the difference between our name being spelled as a human being (a capitol letter then small letters) VS our name being spelled in all capitol letters (that is our name as a corporation or legal person).

I need help, I am new to this and I am on a huge learning curve. I have been called to court by DISCOVER BANK. I have been to court 2 times and have reserved my rights as a living breathing human being...I am not a corporation! DISCOVER BANK's net worth is 68 Billion dollars. I owed $7500, debt incurred during unemployment. $7500 amounts to 0.000011% of DISCOVER's net worth. Not even a penny to them. I have made over 8 attempts to negotiate a settlement. Under contract law, only 2 offers can be made to settle. Under contract law, there never has been a bilateral agreement to borrow $ with DISCOVER. Nevertheless, DISCOVER refuses to settle. Discover has violated two debt collection laws that I know of, maybe more. They have called me up to 6 times a day during work hours and the DISCOVER attorney has threatened me with legal fees.

DISCOVER BANK was bailed out and was never charged interest. DISCOVER would not make the same offer to me. I have been harassed by DISCOVER for over a year now, they have been quiet since I stood up in court and reserved my rights. However, the judge and attorney mocked me for presenting myself as a living human being and reserving my rights. The two judges were not "impartial" to me. Judges collude with attorneys and large corporations and use civil law to threaten human beings with rights under the Constitution. I have one court hearing on tape, unbeknownst to them.

A Judge is supposed to take this oath: 28 USCS 453: Solemn Oath of Justices and Judges. Each justice or judge of the United States shall take the following oath or affirmation before performing the duties of his office: "I, , do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as under the Constitution and laws of the United States. So help me God."

I have provided DISCOVER and the courts an invoice for my services. When they want me to appear or engage in any conversation, I charge them fees that are similar to attorney fees and send them invoices. Thus, DISCOVER now owes me $21,000 for my services. The courts owe me $7500 for each appearance, which now totals $15,000. They have rejected my invoices. Do you think they will pay me?

I need help preparing for my next court appearance. I need Occupy to stand with me and speak with me in court.

I know this probably won't be of much help, especially if you have to worry about your credit rating, although it's probably taken a hit because of this anyway, but there's a statute of limitations on how long they can try to collect that debt. It's somewhere between three and six years depending on the state. If you absolutely cannot pay and you can take the credit rating hit, wait them out. Don't pay. It's not the most responsible thing to do but I don't think you should let it ruin your life too much. Sorry if this seems totally asinine, I just wanted you to know about the statute of limitations.

By the time you go to speak in court, it will probably be too late. You need to get at the very least a knowledgeable and experienced PARALEGAL to help you write and file some type of coherent response on your behalf, and file it well before the court appearance date.

Ideally, in my non law educated opinion, agreeing to pay back in monthly payments what you owed when you made your last payment, with no additional fees, penalties or interest rates tacked on of any kind, once you are employed again, would be a victory for you.

Otherwise, what is worse than the debt is the tacking on of the penalties,fees, filing fees, and monthly interest rate charges on top of what you owe.

I found most of your arguments to be poor rationalizations other than the one that you are out of work.

Do the following google put your five digit zip code in quotes, then the words "pro se" and paralegal.\

You can also try "pro se" and your zip code in quotes, or paralegal and your zipcode in quotes.

If te zip code is not producing a result, you can try your phone area code , once again in quotes, and either paralegal or "pro se", or both.
