For that matter...should anyone be denied by laws the rights to any form of relaxation or recreation? Laws that create criminals and ruin lives...sometimes stigmatized for life.....unable to attain gainful employment?
Why have prisons become privatized for profit enterprises? Is this right?
I don't think so. I believe that we should end the war on drugs and legalize. Make legitimate businesses that pay taxes and provide jobs while at the same time rendering the violence of drug cartels and street gangs totally useless and impotent.
Only people who have injured another by theft or violence should be locked up.
Drugs will always be with us...and truth be told....most users are not addicts.

To the question in your title: If all they are doing is smoking something, whether it be marijuana or crack cocaine, then NO, they should not be deemed a felon. They have committed no crime.
Now, ask me if someone should be deemed a criminal for infringing on the liberty of another person?
Marijuana should be legalized and taxed, and all contraband drug use should be decriminalized. People who suffer from drug abuse should be able to seek counseling and medical help, and friends or families should be able to help an addict without fear that the addict will be prosecuted. Medical marijuana, and other drugs used to treat drug addiction, should be dispensed by pharmacies as prescription drugs are dispensed currently.
I would say considering the money problems our country has it would be a good idea to legalize recreational drugs (that have been strenuously tested to show health affects similar to caffeine, tobacco, alcohol) and tax said drugs just like tobacco or alcohol. Not only do you get the tax money from the legalized drug but you also can save tax dollars on prisoners (marijuana sentenced convicts alone cost the US $1 billion per year) also you open jobs for growers, field workers, stores, transport, and marketing.
It's become a crime because people do become addicted and since the laws are stricter it prohibits some people from trying say, crack. Weed however, should be legalized and taxed.
No. And prison privatization needs to end, one-industry towns built around prisons need to figure out other ways to sustain themselves and the strangledhold of corrections officers' unions in places like California needs to be broken.
