Illegal foreclosures go through the non-judicial process everyday because there is nobody looking at them. Judicial foreclosures must go before the court. Even when a bank does not own the loan and house, they still can foreclose non-judicially. This is wrong and should be stopped to help the economy and homeowners that can not fight this themselves. Please fight for a moratorium on this great injustice. The bank can still foreclose judicially if non-judicial foreclosures are stopped. Stop these illegal acts!

This is where the banks are at their worst. This is the type of thing that needs to be protested. They are lying and breaking the law to take peoples homes. If you do not take up this cause then something is not right here.

Even when they are told to produce the note, when it is a non-judicial foreclosure they simply ignore the request and continue the foreclosure because it is never brought in front of the courts. There are no checks and balances, the banks are on the honor system which they have made a joke of. When they are forced to foreclose legally, like Nevada just decided to do, then foreclosures come to a stop. That certainly screams that things are not right, and need to change.

The bank simply files a little paper work, posts a notice of sale in the local paper and records a notice of trusty sale at the county recorders office. Only about half the states allow this. The banks had convinced them that they would do things by the rules but that is not what is happening. MERS is a whole lot of the problem and it was created for securatizing the mortgages. Some people are foreclosed on illegally and never even know it. It really needs to be stopped.

How do they do this and why is it allowed?

because it costs a lot for people to get an attorney and legal systems need attorneys or you miss your rights. Anyone can file anything, but you have to contest it to protect yourself. Here's one step on how to protect yourself from foreclosure.
