Forum Post: Bloomberg Occupies Public Sidewalk in Front of His NYC Palace

Yesterday, OWS people were told that the public sidewalk in front of Casa Bloomberg, otherwise known as Bloomberg Palace, is a "Frozen Zone" . Have u ever heard of a so-called "Frozen Zone" before? Next time OWS is ordered off of public property, tell them it's now a Frozen Zone. Actually, Bloomberg is OCCUPYING a public sidewalk, paid for with hard earned money assessed against NYC taxpayers. So here we have a mayor (serving what should be an illegal 3rd term) doing what he says no one else can do.

I was outraged when I arrived at this protest to find that protestors were not allowed anywhere near the Bloomberg brownstone. The entire block was cordoned off as was the entire block accross the street.

I just googled "frozen zone". Apparently it is used if there are terrorist threats.

This is just disgusting. Bloomberg has no respect for civil liberties at all.

Castle doctrine. Google that and then imagine what a mob coming to your private residence would look like.

Castle Doctrine has no application in this instance. Castle Doctrine is the legal right to protect a person's private residence from intrusion. No protester wanted to nor did they attempt to set foot on Bloomberg's property. This is NYC. No individual (not even Tsar Bloomberg) owns the sidewalk in front of their house. It is public property. Citizens have the right to protest on public sidewalks.

All one person has to do is be in fear for their safety and they'd be justified in shooting at a mob to defend themselves. I'd guess the mayor got enough death threats and terroristic threats in the mail this week to say he'd be in fear of his safety. OWS isn't your normal peaceful protest, like he's seen before, that's for sure.

No, it isn't qute that easy as fearing for ones safety in a public place that gives one carte blanche to shoot to kill. If it were that easy, we could all go shoot people we didn't like with impunity.

Castle Doctrine applies ONLY to the invastion of one's castle -- not to the public space surrounding one's castle. If you are in public space and you fear for your safety and shoot someone, you better be able to prove that your fear was justified and that you have a right to carry a gun.

On the other hand, the First Amendment to the constitution provides for freedom of assembly - the right to peaceably assemble and to petition the government for redress of grievances. This has been interpreted by the courts to mean that one has the right to protest on the public land directly abutting a private residence. This is the same right used by people who protest outside a convicted pedafile's residence after they learn one has moved into the neighborhood.

OWS has been a very peaceful protest on the part of the protesters. Arrests were made largely for blocking traffic. What makes OWS so scary to many and certainly to the ruling elite, is the size and tenacity of the protests. If the protests do not stop, our elected officials will have to respond to the needs and desires of the people or to acknowledge publicly that they do not give a damn what the American people want. If they do respond to the needs and desires of the people, the elite will have to share economic opportunity. The ruling elites are fighting tooth and nail to avoid doing this.

It would look like what it was and exactly what it looked like. It was a legal constitutionally sanctioned protest. Many have protested at Bloomberg's residence in the past. It is nothing he and many other public officials have not experienced in the past. It comes with the territory.
