Federal Hall National Memorial is across the street from the NYSE. This may allow a successful challenge to the NYPD exclusion zone.

The Federal Supremacy clause of the Constitution prohibits states from interfering with the missions and activities of the federal government.

As the National Memorials mission requires free access by ALL visitors and the site is dedicated to freedom of the press and the establishment of the Bill of RIghts, it is arguable that NYPD can not prohibit access to the site.

It is even arguable that the Memorial manager can not AGREE to such limitation.

Last point: Each national park site manager is required to set aside space for public expression. Federal Hall advertises the history of public expression on the steps.See the compendium of rules available from the site manager.

One can easily envision an argument that NYPD MUST allow acces by persons holding a permit to express themselves on the steps of a national memorial established to celebrate the Bill of Rights.
